Staying Compliant: How to Adjust Your TCPA Disclaimers for 2025

September 30, 2024

Hello, ZAN Advertiser!

As you may know, growing concerns about unwanted calls and consumer confusion have led the FCC to update the rules.

What’s new?

Starting in 2025, all TCPA disclaimers must follow a one-to-one consent approach. This means consent to contact from multiple marketers will no longer be valid. Moving forward, we’ll only be able to allow one company per TCPA disclaimer.

To this end, Zeeto will begin a transition process on October 1st. We’ll be identifying TCPA copy that includes multiple companies, and we’ll need your help updating them.

What should you do?

First, please review the creatives in your existing SOI Phone campaigns. Remove any references to “marketing partners”, “affiliates”, or any other language referring to multiple companies. The goal is simple: one company per disclaimer for 1:1 consent.

What is the right approach if you represent multiple companies?

We’ve come up with a simple solution: one creative per company. For each company you need to represent, create a separate creative with a unique TCPA that mentions only that company. Then name the creative for that specific partner. To route correctly on your end, pass the ‘Creative Name’ with every lead. This will allow you to see which client (creative) the visitor consented to.

What not to do?

Avoid creating multiple, identical campaigns, each for a different company. While this may seem like a solution, it will cause your campaigns to compete with each other, reducing volume and forcing you to increase bids.
